Formål

The purpose of the study in this course of comparative labour law and industrial relations is to enable the student through readings, research assignments and participation in instructional activities to be able to identify currently important issue areas within the subject field, understand different national approaches taken to the resolution of policy interests in these issue areas, and the implications of these approaches.

After having participated in prescribed instructional activities in this course, the student will be able to:

  • Describe the problematique raised in the particular labour law subject areas taken up in the course and understand typical approaches taken in national law and industrial relations practice to resolve them,
  • Compare and contrast different approaches taken in national labour law and industrial relations practices, citing different characteristics and implications of approaches taken,
  • Relate approaches taken in labour law and industrial relations practices subject areas to different current labour and product market characteristics, thus being able to judge implications of law and practice solutions transplanted outside of their native context,
  • Convincingly argue why particular approaches taken in labour law and industrial relations practices would be appropriate or not in a foreign context, and justify argumentation correctly,
  • Formulate, on the basis of study done in the course, elements of labour law and industrial relations practice that could be used to resolve with a view to achieving particular policy outcomes issues raised in individual and collective employment relations.

Indhold

The course is based on the notion that comparativism is no longer a purely academic exercise and that is has become an invaluable aid for legal practitioners against the background of ever increasing globalisation, multinational enterprise and crossborder regulation.
The course is organized along seven broad themes, and will focus on comparing legal solutions found to challenges posed within the theme areas, all of which relate to labour and industrial relations.
The seven themes are:

  1. Introduction to the course and comparative study of labour law,
  2. Parties at the workplace and the changing world of work,
  3. Individual employment relations (setting employment conditions, contracting and atypical forms of work, termination at the initiative of the employer, dispute resolution),
  4. Collective bargaining and social dialogue (levels of bargaining, parties to bargaining, extension of collective agreements, rights to inormation, European Works Councils),
  5. Resolution of colective rights and interests disputes, including the right to strike,
  6. Working time,
  7. Workers´ Proctectiom - Equality, migration for employment, income protection in case of unemployment and old age.

Since the course is issue oriented the labour laws of individual countries will not be systematically examined. Nevertheless, European countries are an important focus point in practice since students come from these countries and the countries provide a good basis for comparison of different approaches. Comparisons are also drawn from Anglophone countries such as the United States, Canada, the United Kingdom, Australia, and some developing countries.
