Formål

The purpose of the study in this course of international labour law is to enable the student through readings, research assignments and participation in instructional activities to be able to identify current sources and characteristics of soft and hard law in this area, understand mechanisms used by institutions in this field to make, promote and enforce relevant bodies of law, know the essential elements of the most important international labour laws.

After having participated in prescribed instructional activities in this course, the student will be able to:

  • Identify, describe, compare and contrast different institutional sources of international labour law and the relevant characteristics of the body of law of each,
  • Identify, describe, compare and contrast approaches taken to the enforcement of bodies of international labour law by relevant institutional mechanisms,
  • Explain and execute essential procedural elements related to the system of international labour standards of the International Labour Organization,
  • Use correct terminologys related to systems of international labour laws,
  • Explain essential elements of the international labour laws taken up for study during the course.

Indhold

The focus of this course is the international labour law jurisprudence og the International Labour Organization. A secondary focus is on jurisprudence of the European Union in social matters. The relation between these bodies of law and the operation of "Codes of Conduct" and other forms of voluntary business initiatives deadling with labour matters will be drawn out throughout the course, along with linkages to other instruments, initiatives, and bodies of "soft law" including:

  • the Tripartite Declaration of Principles concerning Multinational Enterprises and Social Policy;
  • the UN Global Compact;
  • the ILO Declaration on Fundamental Principles and Rights at Work;
  • the OECD Guidelines for Multinational Enterprises; and
  • unilateral and bilaterial trade regimes linking labour standards with international trade.

At the end of the couse students will be able to engage in work that involves areas of the law, i.e. reporting on behalf of government, workers´ or employers´ organizations, setting in motion or defending against actions based on the jurisprudence; etc.

Background in labour law preferable, but not required.

Undervisnings- og arbejdsform

This course is designed to give students hands-on experience in using international labour standards to pursue worker/employer/government interests. This is done by student´s "immersion study" in working through a set of 7 role-plays during the course. Through the materials, as well as trough lectures and readings, students are introducted to:

  • the substance of international labour standards on freedom of association and collective bargaining, equality, forced labour, child labour, migration, and other subject areas; and
  • procedures related to the making of these standards, their promotion and enforcement, including special procedures concerning freedom of association.

The students are expected to participate actively in class.
