Formål
During the course, the students will gain
-
a solid foundation in international trade law and policy as expressed in WTO agreements
-
a basic understanding of key environmental policy concerns, environmental law principles, and modes of environmental regulation
-
an understanding of how international trade law relates to specific environmental rules and regulations
-
an awareness of how future environmental policy and trade policy can work to avoid conflict and achieve mutual goals
On the basis of the recommended literature and class discussion, students should be able to:
-
describe the core principles of international trade law and their application
-
describe the functioning of the WTO, in particular the process for the settlement of disputes
-
explain key principles and objectives of environmental policy
-
identify the important similarities and differences between WTO law and EU law with respect to trade aspects of national environmental regulations
-
analyze the application of trade law to national environmental regulations, including
-
--Technical standards and labeling regulations for products
-
--Measures for food safety and protection against pests and diseases
-
--Measures for the conservation of natural resources
-
--The effect of environmental rules on foreign investors
-
understand and be able to explain the legal relationship between trade law and international environmental agreements
-
identify and explain the possible trade law problems presented by specific environmental rules and regulations with correct usage of relevant trade and environmental terminology
-
formulate proposals for achieving environmental goals consistent with trade law with proper reference to both trade and environmental law and policy principles and concepts
Indhold
Students will be introduced to the key concepts and principles and theoretical premises for the system of open international trade on the one hand and for national and international efforts to protect and enhance environmental conditions on the other. Then the course will examine specific legal requirements of international trade law and similar EU law and how they apply to environmental considerations related to products, to manufacturing processes, to protection of human health, and to the conservation of natural resources. The major topics will be:

4. Nondiscrimination principles in trade law

5. Comparison of WTO and EU law

6. General exceptions to trade law for certain environmental measures

7. WTO law on product standards, labeling, and harmonization

8. Food safety regulation and protection against pests and diseases

9. WTO and EU rules on subsidies
-
10. Multilateral environmental agreements and trade

11. Environmental measures and foreign direct investments.
